Rules and Regulations




I will now research Rules and Regulations of Sainsburys, Barnardos and TFL online websites and employment law in the UK.


 

 

Rights at work


Employee rights at work will depend on:-
  • Employee statutory rights
  • Employee contract of employment

Contract of employment cannot take away rights that employee has by law but if contract gives greater rights for employee than he/she has under law then contract applies.


 There are special rules about the employment of children and young people.



Statutory rights


Statutory rights are legal rights based on laws passed by Parliament.

Unless they are in the group of workers who are excluded all employees will have the following statutory rights:

  • the right to a written statement of terms of employment within two months of starting work.
  • the right to an itemised pay slip.
  • the right to be paid at least the national minimum wage.
  • the right not to have illegal deductions made from pay.
  • the right to paid holiday.
  • the right to time off for trade union duties and activities.
  • the right to paid time off to look for work if being made redundant.
  • the right to time off for study or training for 16-17 year olds.
  • the right to paid time off for ante natal care.
  • the right to paid maternity leave.
  • the right to paid paternity leave.
  • the right to ask for flexible working to care for children or adult dependents.
  • the right to paid adoption leave.
  • the right to take unpaid parental leave for both men and women .
  • the right under Health and Safety law to work a maximum 48-hour working week.
  • the right under Health and Safety law to weekly and daily rest breaks.
  • the right not to be discriminated against.

  • the right to claim compensation if unfairly dismissed.

Workers not entitled to certain statutory rights


  • anyone who is not an employee, for example, an agency or freelance worker.
  • employees who normally work outside the UK
  • members of the police service.
  • members of the armed forces.
  • merchant seamen and share fishermen
  • merchant seamen and share fishermen
  • trainee doctors are not entitled to paid holidays and have to rely on their employment contract. They are also limited to working a 58 hour week, rather than 48 hours.

Rights under the contract of employment


The contract of employment is the agreement made between the employer and the employee. This could be in the form of a written agreement or what has been agreed verbally between them.

Illegal contracts of employment


  • the employee gets all or part of their wages as ‘cash in hand’; and
  • tax and national insurance contributions are not paid; and
  • the employee knows they are getting paid in this way to avoid paying national insurance and tax.


Written statement of the main terms and conditions of employment

All employees are entitled to receive a written statement from their employer, within two months of starting work. The statement describes the main terms of the contract of employment.


The statement has to give details about:


  • job title
  • wages
  • hours of work
  • holiday entitlement
  • sick pay
  • pension schemes
  • notice
  • grievance, dismissal and disciplinary procedure

 Harassment and discrimination

Employees has rights not to be treated worse than other people at work because of their:
  • age
  • disability
  • pregnancy or maternity leave
  • race
  • religion or belief
  • sex
  • sexual orientation
  • gender identity.

Sainsburys website -Although they ask for date of birth, age plays no part in the selection process. Regrettably, applicants under 18 years of age cannot be employed for night shift replenishment, counters, warehouse, team leaders or petrol filling station positions, this is due to health and safety requirements. In addition to satisfy legal requirements all our members of management must be over 18 years of age.


 

Aplicants under 18 cannot be employed in some positions due to health and safety and legal requirements.


 

 

 

Sainsburys website - Applicants has to provide a document which shows their right to work in the UK. It can be British, UK colonies, EEA country or Switzerland passport or identity card; residents permit, a permanent residence card and etc.

Customer’s rights

  • Customer’s data is protected in the UK by the Data Protection Act 1998. The data they hold about customers will be processed lawfully and fairly and will be kept securely.

  • Wireless Telegraphy Act 1967 says that if customers are buying any device to receive TV signals Sainsburys is required to notify TV Licensing authority and provide full details of the address where they’ll deliver TV.



 

 

Availibility

If they are unable to supply any particular item they’ll ensure that customer’s not charged for that item.


 

 

Descriptions and product information


Appearance of theirproducts may be different from they way it looks on their website and allmeasurements and sizes are approximate.


 

  

Delivery

 
They can only deliver their products to mainland UK and Northern Ireland addresses. It is customers responsibility to check access to their premises and to inform them about any special delivery requirements.





 

 

 

Services
Charges for delivery or recycling or installation are not included in the price of goods.



 

Cancellation, returns and refunds

Customers have a right to cancel their order up to 28 days. This includes right to cancel order under the Distance Selling Regulations.
Goods made to customer's specification cannot be returned for any reason. They could accept returns in exceptional circumstances but they'll charge cancellation fee of 20% of purchase price.
Customers can't return products in the following categories unless they are faulty: perishable goods, personal grooming products, ink cartridges, headphones, opened CV, DVD, Blue Ray, opened recording media, items that cannot be resold for health and hygiene reasons if they are already unwrapped or used.

I will now research: 1) what do Sainsburys, Barnardos and TFL organizations do about collecting payment; 2) how they manage these issues; 3) how do customers pay and get refunds; 4) what can be done to prevent fraud.


Sainsburys


Deliveries


They offer various delivery options with different prices. Prices depend on a delivery time, Click and Collect delivery is for free.


  • Standard delivery - costs £3.95, orders delivered within 3-5 working days Monday to Friday from 7am to 7 pm.
  • Next day delivery - costs £4.95, orders delivered Monday to Saturday from 7 am to 7 pm. Orders must be placed before 2 pm to receive the order next day, orders placed on a Saturday, Sunday and Bank Holiday will be delivered one day later.
  • Named day delivery - costs £4.95, orders delivered on the day of choice Monday to Friday on a selected half day slots.
  • Saturday delivery - costs £4.95, delivered from 7am to 12pm or between 7am to 7pm.
  • Click and Collect - is free, orders can be collected from selected Sainsburys stores, order is available to collect within 3-5 working days of placing order.

Click and Collect service

Customers have to bring order number, payment card that was used to collect order. Customers may want someone else to collect their orders. To prevent fraud, the person who was nominated has to bring order acknowledgment email, photographic ID belonging to them and the person's who made an order ID.

Returns and Refunds


  • Returns are accepted within 28 days and will be refunded if the product is in good condition: in original undamaged packaging, with labels still attached and along with any free items.
  • Refunds are made within 30 days to the debit or credit card on which the purchase was made.
  • Sainsburys will not accept returns in following categories unless they are faulty: perishable goods, personal grooming products, ink cartridges, headphones, opened CD, DVD, Blue Ray, opened recording media, items that cannot be resold for health and hygiene reasons if they are already unwrapped or used.
  • They could accept returns in exceptional circumstances but they'll charge cancellation fee of 20% of the purchase price.
  • It is available to return grocery products at the time of delivery for any reasons, including the price of delivery.

Payment


  • Payments are taken at the time they receive an order and once they have checked card details and stock availability.

  • To prevent fraud, billing address and the address at which the card is registered must be the same.
  • Personal information supplied will be validated against third party databases during the order process.
  • Sainsburys website is HTTP secured.
  • It is asked to create a password when registering.





 

Barnardos


Donations

  • Direct donations online - using credit or debit card.
  • Barnardos online shopping - buying Barnardos products online. Profits from purchases go straight to the charity.
  • Customers can make regular donations or one off donations.

Fraud preventions

  • Barnardos website uses a secure server. All information provided will be encrypted during transit over the Internet.
  • It's asked to create a password when registering.

Payments


  • To make a donations customers should choose Donation Amount, Frequency and Payment Day.
  • Barnardos has been allocated three payment dates - the 5th, 10th and 20th of the month and customers has to choose from one of those days.
  • If an error is made by Barnardos or customers bank or building society, customers are guaranteed a full refund.
  • Customers can cancel a direct debit at any time.
  • Frequency, amount and payment day can be changed by phone.







TFL


Charges

  • TFL has the right to refuse to deal with a request that would cost more than £450.
  • VAT will be charged on any fees calculated.

 Organisational structures




I will now 1) explain types of organisational structures and 2) research Sainsburys, Barnardos and TFL organisational structures.


 

 
3 types of organisational structures:
  1. Hierarchical - this type of organisational structure has many different levels of employees and and levels above are responsible for levels below. The more levels of employees are in organisation the harder communication between them is.


     

     
  2. Flat - organisational structure that doesn't have most of middle managment level and has only highest and lowest levels of employees. Communication within levels of employees is much faster than in hierarchical organisation, problems are solved more effectively.


     

     
  3. Matrix - teams of employees with different skills and expertise, managers and staff are directly responsible for completion of project. This type of organisational structure is mainly used in specific projects.

Develop and implement the Crossrail’s Skills and Employment communications and marketing strategy. Ensure effective and timely marketing of the tunnelling academy, it services and opportunities.

Funding





I will now explain the ways how people and organisations raise capital for business. 

 

 

Ways of raising capital for business:

  1. Parents / Family. Bad point is that you haven't worked for it and money got easily are spent easily as well. Good points are that there's probably no/low interest and flexible repayment. 
  2. Bank loan.  Bad points are high interest - about 7%-8% and regular repayments - every month, so you can't delay your payments otherwise you'll get low credit rating which could cause problems in a future to get another loan, buy property and etc. Good points are that you keep equity of your business and that it's private, so no one  has to know about that.
  3. Work / Savings. Bad point is that you risk to loose everything. Good point is that you earn the money you investing, so you are more concerned about the success of business. 
  4. Investors / Venture capitalist.  Bad points are that it's the same as working for other people, you loose independence. Good point of this is shared risk, so you risk to loose only the part you invested.
  5. Sponsorship. Bad points - needs contacts and a brand that could add a value. Probably won't work for new businesses as sponsors won't be interested in an unknown brand.
  6. Selling your possessions. Good point is that you can get your stuff back, on the other hand there's still bad point - you'll need to pay higher price than you got for selling them to get them back, so you'll loose some money. It could happen that in the future you'll still need to replace the stuff you sold so you should sell only that stuff that you never needed and never will. 
  7. Loan shark. Bad points - extremely high interest with regular repayments, high risk of loosing lots of money. Probably the worst way to raise capital for business.


 
 

 


 
 

 
Ways I would choose  myself - Firstly - work / savings. I think that it's the best way of raising capital, as you have bigger responsibility for your actions when you invest money that you had to work for. Another reason why I would choose that way is that you wouldn't owe anything to anyone, so you have equity and independence of your business.


I wouldn't choose - definitely loan shark. It doesn't have any good points and too much risk.





Barnardos


Barnardos is NGO and this company's purpose is to help children but not to raise a profit. 
They need money to help children and to support their operations. Ways they raise money : 

  • Donations - people can donate online, they can choose if they want to make regular or only single donations.
  • Charity shops, online charity shops. They sell stuff that people donated for them and some items they made themselves. All the income is for children. They have to invest some money into premises, manufacturing costs, but it is essential to invest money into operations, otherwise they won't get any income.
  • Fundraising events. They run different fundraising events and anyone can join them. Those events have only one purpose - to raise money for children. It's a good way to attract different people's attention from anywhere across the country and to make them donate their money.

Reasons for setting aims and objectives


Having aims and objectives gives an organisation a strategy.  
Smart targets – they can be analysed and it is easier to see what to do if anything needs to be done to achieve them.
If you already set long term goals you can easily plan your short term goals.

•Positioning - It describes where Organisation is in the market
•If a company has a competitor, it needs to consider what it's competitor is doing right and wrong and do something about it to change it

•Marketing - helps the organisation to show itself as a distinctive brand from other companies
